Refer to the Applicable Conditions subsection for each Appeal’s description in the Appeals Definitions chapter for Appeal criteria associated with the types of irregularities.

Accessibility

Incorrect Resource or Accommodation Setting (For All Assessments)

A designated support or accommodation required by the student’s IEP or Section 504 plan was set incorrectly and needs to be changed.

Incorrect Designated Support (For the Summative ELPAC and Initial ELPAC Only)

A designated support for a student without an IEP or Section 504 plan was set incorrectly and needs to be changed.

Incorrect Designated Language Support (For CAASPP Only)

A designated support for either a translation (stacked or glossary) resource or the streamlined interface for a student without an IEP or Section 504 plan was set incorrectly and needs to be changed.

Incorrect Domain Exemption

Incorrect Domain Exemption (For the Initial ELPAC Only)

A student did not receive a domain exemption as prescribed by the student’s IEP or Section 504 plan.

Incorrect Domain Exemption (For the Summative ELPAC Only)

A student did not receive a domain exemption as prescribed by the student’s IEP or Section 504 plan.

A student received a domain exemption but for the wrong domain as prescribed by the student’s IEP or Section 504 plan.

Administration Error

Scores for the Speaking Domain (For the Summative ELPAC Only)

A test examiner did not score the Speaking domain responses in real time and cannot determine scoring from voice capture.

Incorrect Test Session Type Selected (For All Except the Alternate Assessments)

A test examiner incorrectly selected to start an in-person session instead of a remote session to administer a general assessment.

Applicable for remote test sessions only— While administering a remote test session, a test administrator or a test examiner incorrectly selected to start an in-person session instead of a remote session.

Administered Incorrect Assessment

A student was unintentionally administered a summative assessment for practice instead of the practice test or interim assessment (CAASPP only), or the wrong grade-level assessment, or with the wrong Special Education designation listed in TOMS, for either CAASPP or ELPAC; or the Initial ELPAC or Summative ELPAC was administered to ineligible student(s).

Incorrect SSID Used

No Swap

Student(s) took an assessment(s) associated with a different student’s SSID and is not eligible to test in the assessment taken, or a student’s assessment was taken by another, unidentified student.

Swap

Student(s) took assessment(s) or domain(s) using a different student’s SSID, and vice versa, and the completed assessment must be associated with the student’s correct SSID.

Student Cheating or Accessing Unauthorized Devices

Student(s) Cheating or Providing Answers

Student(s) cheated or provided answers to each other, including passing notes and giving help to other students during testing.

Student(s) Accessing Internet or Unauthorized Devices or Software Applications

Student(s) accessed or used unauthorized electronic equipment (for example, cell phone, tablet, smartwatch, smart glasses, non-embedded calculator, or Bluetooth earbuds) during the student’s testing session.

Validity

Student Does Not Respond (For CAASPP Only)

A student deliberately did not attempt to respond appropriately to items.

Irregularity Flag Submitted in Error (For ELPAC Only)

Incorrect Notification of Irregularity Flag on the SSR

An Appeal submitted earlier with an incorrect irregularity flag needs to be revoked.
